1. GENERAL TERMS AND CONDITIONS

The present general terms and conditions apply to all sales of products carried out by Sony Music Entertainment on the website www.pommelienthijs.be. This website and related services are offered by:

By using the Website, you expressly accept our General Terms of Conditions, as well as all other rights and obligations stated on the website.

Sony Music Entertainment reserves the right to amend and/or supplement the General Terms and Conditions in the future.  Any future changes will have no effect on existing product orders and consequential losses or damages.

2. OFFER

Sony Music Entertainment is doing its utmost to display all products as clearly as possible, by using photos, texts, prices etc. The colors of products displayed on the website may vary depending on the monitor from which they are viewed and can differ across  different monitors. An offer is only valid while stocks last, Sony Music Entertainment can’t guarantee that all items included in the web shop are in stock at the time of your order. In case an ordered item is no longer available, Sony Music Entertainment will inform you by phone or email.If Sony Music Entertainment is unable to contact you, your order will be automatically cancelled. In such case, all payments that have been made will be refunded within 14 days. No party will be entitled to claim any compensation due to this cancellation.

3. T-SHIRT PRINTING SERVICE DURING LIVE SHOWS OR IN POP-UP STORES

Sony Music Entertainment offers a T-shirt printing service during certain shows or at a pop-up store dedicated to Pommelien Thijs. Customers can bring a blank T-shirt at a designated time before the start of the show or at the pop-up store and have it printed. They can then pick it up at the end of the show or at the pop-up store at a designated time. Reservations for this service can be made through our website. To use this service, customers must bring a clean and blank T-shirt that is in good condition. Sony Music Entertainment reserves the right to refuse any T-shirt for this service. 

In the event that a submitted T-shirt is damaged during the printing process, or a printing error occurs, the sole remedy provided by Sony Music Entertainment will be the issuance of a new printed T-shirt in the correct size. In such cases, the customer will only be charged for the printing service. While Sony Music Entertainment will make every effort to ensure that the print is of high quality, it is not responsible for minor variations in color or print compared to the reserved design on the website.

The product resulting from this printing service is considered a personalized item that cannot be returned or exchanged. 

4. ORDERING

To purchase a Product from Sony Music Entertainment, the purchaser must complete our online ordering method. All orders placed on the website will be confirmed by mail as confirmation of the agreement. The confirmation will include all information concerning the order, including information about the items ordered, the price, the delivery rate and other relevant information. Sony Music Entertainment reserves the right to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a client with whom there is a dispute concerning the payment of previous orders.

5. RIGHT OF WITHDRAWAL

The consumer has the right to withdraw his order or return the products (except for the orders mentioned in article 3 above) within 14 days after reception of the goods by the consumer. If for any reason you are unsatisfied with your purchase, you can return the goods in their original packaged condition at your costs and at your own risk.  Only after the returned items have been received and approved by Sony Music Entertainment, the amount of the purchase price will be refunded to the purchaser’s account within 14 days. Import taxes, customs duties, shipping costs will not be refunded, even if it is a partial return. The return will not be accepted and no repayment will be made if the product is not returned in the same condition or shipping costs have not been paid.

If you want to return an order or part of your order, please send an email to webshop@pommelienthijs.be with your name and order number and the items you wish to return. You will receive instructions by mail to send back the goods.

6. PRICING

All prices towards customers are indicated in euro and include Belgian VAT. Shipment prices will be mentioned separately, if applicable. Discount codes can’t be combined with each other and only apply to full priced items.

Sony Music Entertainment has the right to change prices at any time but commits to apply the prices that were indicated on the website at the time of your order. Price changes that are due to changes in VAT will be borne by the purchaser.

7. PAYMENT

Payment should take place using one of the payment methods offered on our webshop. The customer declares to only use payment cards or credit cards with sufficient funds for the payment to be made and which he/she is entitled to use. The total cost of your items purchased plus shipping fees as displayed on the payment website page of your order will be billed to your card.

Sony Music Entertainment shall only deliver the order upon receipt of the full payment of all amounts due by the customer. Sony Music Entertainment always retains ownership of all products ordered until full payment of all amounts has been made.

8. DELIVERY

Sony Music Entertainment will process every order as soon as possible. We use reasonable endeavors to deliver your products to the delivery company within five (5) business days after the order confirmation.  This delivery period is purely indicative and we cannot give any guarantees in this respect. 

Sony Music Entertainment will not be held responsible for delays from the couriers.
When your order leaves the company, you will receive an e-mail. In case of delay of the delivery time or if we are not able to deliver the ordered product, we will send you a notification and you will have the right to cancel your order within 10 days after our notification. 

9. PRODUCT VARIATIONS

Regarding the colors and textures of items on the website, we would like to point out that the items can vary in color and structure from product to product and from collection to collection. These minor irregularities are normal characteristic of our product.

10. LEGAL GUARANTEE & COMPLAINT POLICY

Sony Music Entertainment provides a two-year legal guarantee according to the European consumer protection legislation covering defect manufacture and materials registered during normal use of the item. The original invoice must always be included to confirm that the return is within this legal timeframe. All goods are your responsibility until they reach our company.

This legal guarantee does not cover defects, damages or wear and tear, resulting directly or indirectly from wrongful use, bad maintenance, violence or unauthorised use. Complaints regarding defects or faults discovered during normal examination of the item must be communicated to webshop@pommelienthijs.be within 48 hours after taking receipt of the goods, by sending photos of the issue. Complaints in respect of hidden faults must be immediately notified to Sony Music Entertainment by the customer within a period of 8 days after discovery, by an email to webshop@pommelienthijs.be. Sony Music Entertainment will respond to all complaints within 10-14 days depending on the nature of the problem. Subsequently, these items may be returned for exchange or, if agreed upon, reimbursement.

Customers within the EU may file complaints to the EU's online dispute resolution platform (the ODR platform). The ODR platform offers consumers and traders within the EU the possibility of reaching an out-of-court settlement for complaints arising from online purchases. The ODR platform is available here: http://ec.europa.eu/odr.

11. FORCE MAJEURE 

Force Majeure exists if Sony Music Entertainment is, wholly or partially, prevented to accomplish its obligations towards the customer by circumstances beyond its control. In this case Sony Music Entertainment is not obliged to fulfil its obligations. Sony Music Entertainment may suspend its obligations for the duration of the force majeure.

12. INTELLECTUAL PROPERTY

Pommelien Thijs is a registered trademark. 

Sony Music Entertainment retains all intellectual property and other related rights with regard to the website. These intellectual property rights include copyrights, trademarks, design rights and/or other rights, including technical and/or commercial know-how, methods and concepts, whether or not patentable. Elements of the website and items brought through the website can only be used for private use, unless special dispositions are previously made (as using specific elements that Sony Music Entertainment allows to share on social media). Any other use is constitutive of counterfeit.

13. APPLICABLE LAW AND COURT 

These General Terms and Conditions shall be governed and interpreted exclusively in accordance with Belgian law. All offers and sales contracts are governed exclusively by Belgian law.
As Sony Music Entertainment is based in Brussels (Belgium), all complaints can be presented to the courts of the judicial district of Brussels or to the courts of the jurisdiction where the consumer is domiciled. The webshop www.pommelienthijs.be/shop directs its activities exclusively to Belgium and the Netherlands.
